Description
Per Curiam. Plaintiff is a Michigan development company which brought a diversity action in federal court to recover money paid to the defendant under contractual agreements between the two parties. Plaintiff argued to the district court that it was entitled to recover default charges and interest it paid, notwithstanding its own breach of the contract, because plaintiffs breach allegedly occurred only after the defendant first breached the contract. The district court granted the defendants motion for summary judgment, finding that the defendants allegedly improper conduct was not prohibited by the contract between the two parties. Finding no error in the district court analysis, we affirm.
